Agreement for use of the Connected Homes Marketplace
Effective Date: September 1, 2025
Please read these Terms and Conditions ("Terms") carefully before using the Connected Homes mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms and all policies incorporated by reference. If you do not agree to all of these Terms, do not use the App.
1. Use of the App and Service
The Connected Homes App is a marketplace platform that connects real estate agents, sellers, buyers, and renters. We do not act as a real estate broker, agent, lender, or property manager. We are not a party to any transaction between Users.
- Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the App.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- User Verification (KYC): We may require users, particularly agents and sellers, to submit Know Your Customer (KYC) documentation for identity verification. We reserve the right to suspend or terminate accounts that fail the verification process.
2. User Content and Listings
All property listings, photos, videos, descriptions, messages, and profile information posted by you are considered "User Content."
- Ownership: You retain all ownership rights in your User Content, but grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the App and its marketing.
- Accuracy: You warrant that all Listing/Property Data you provide is accurate, current, complete, and not misleading.
- Prohibited Content: You agree not to post content that is illegal, fraudulent, defamatory, discriminatory, or infringes upon the intellectual property rights of others.
3. Prohibited Conduct
You agree not to do any of the following:
- Use the App for any purpose that is illegal or prohibited by these Terms.
- Attempt to gain unauthorized access to the App, other User accounts, or computer systems or networks connected to the App.
- Engage in any form of **spamming, phishing, or unsolicited commercial electronic messages (UCE)** through the App's communication features.
- Use the App to solicit or perform services outside of the platform with the intent to circumvent service fees.
4. Disclaimers and Limitation of Liability
- DISCLAIMER OF WARRANTIES: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY LISTINGS OR OTHER USER CONTENT.
- LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY LAW, CONNECTED HOME LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE APP.
5. Termination
We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately. Sections related to ownership, disclaimers, indemnity, and limitations of liability will survive termination.
